Michael Moragia Nyachae, the son of former Minister Simeon Nyachae, has been charged with allegedly stealing more than Ksh. 1.2 million belonging to Sansora Group Limited. Nyachae is accused of unlawfully taking Ksh. 1,226,036 on various dates between March 28, 2019, and September 28, 2021, in Kisii County. According to the charge sheet, the alleged offence was committed contrary to Section 268(1), read together with Section 275 of the Penal Code. The prosecution claims that the money allegedly stolen was the property of Sansora Group Limited.
Nyachae pleads not guilty
Nyachae appeared before Magistrate Caroline Nyaguthie, where he denied the theft allegations and entered a plea of not guilty. Through his lawyers, the accused asked the court to grant him bail pending the hearing and determination of the case. His legal team urged the magistrate to exercise discretion when considering the bail application, citing Nyachae’s family background. The lawyers also dismissed the allegations, describing the case as “smoke without fire.”
Lawyers say company is family-owned
Nyachae’s lawyers told the court that Sansora Group Limited, the company named in the charge sheet, is a family business. They argued that the circumstances surrounding the case were unusual and asked the court to consider them when making its decision on the accused’s release. After considering the application, the court granted Nyachae a bond of Ksh. 200,000 or a cash bail of Ksh. 50,000.
Case to return to court on September 29
Magistrate Caroline Nyaguthie directed that the matter be mentioned on September 29 for pre-trial directions. The court said the directions would take into account the circumstances surrounding the case as the proceedings move forward. Nyachae will remain subject to the terms of the bond or cash bail as the case proceeds.
